U.S. Citizenship and Regain U.S. Citizenship

To qualify as a U.S. Citizenship, you must demonstrate, normally, that you have at least 5 years in U.S. lawful permanent resident status, you are a person with good moral character, and you are willing to pledge alliance with the USA. The United States does not approve dual citizenship except for Canadian Citizenship. However, unless you are an elected official, you don’t have to renounce your own country of citizenship as many people misunderstood.

At least half of the resident time must be in USA. In some situations, you may apply for US Citizenship in 3 years (if married to a U.S.C) or even the NEXT DAY after you got the Green Card. Contact us to inquire these special questions.

Regain the U.S. Citizenship

Good Moral Character

To qualify for the U.S. citizenship, you have to show you are a person of good moral character. However, even if you were never convicted of a crime, it does not mean you are a person with good moral character. You can be a habitual drunkard, a professional gambler, or a person associated with drug business or owe U.S. Government money or failed to pay child support, etc. On the other hand, you may have some convictions in crime, but still can qualify for being a person with good moral character. So the legal analysis is on a case-by-case basis and can be complicated too.

Delay Birth Certificate and U.S. Passports

Recent years, the U.S. Government has routinely refused to issue you a passport if you obtained the U.S. citizenship by “delayed birth certificate” through a midwife. Even more drastic situation, the CBP officer may choose to deny your admission into the U.S.

Mr. Yuen has successfully defended a Mexican/U.S. Citizen criminally who obtained his DELAY BIRTH CERTIFICATE with two felonies charges, 18 USC 1001 and 18 USC 991 for accusing him of false claims of U.S. Citizenship and lied to a Federal officer during admission. The 12 jurors had found him “not guilty” and the Court acquitted him for all charges. But the long detention at the Federal detention center and great legal expense had been a torturing experience for him.
